As this mode of communication is constantly evolving, the methods of addressing it when it comes to discovery are also changing. Firms and corporations should have a plan in place to address social media, regardless of the stage of evolution. The panel will touch on the unique aspects of discovery response planning, recent case law, employer liability, and new ethics concerns.

Gordon J. Calhoun
Gordon represents individuals, partnerships, corporations and other business entities in litigation and counsels them about a broad variety of business, regulatory and risk and information management protocols, including data breach responses, and compliance practices. Mr. Calhoun works regularly with a team of Lewis Brisbois attorneys and a variety of forensic consultants and certified records managers to assist clients to develop information management systems and to secure sensitive data. One side benefit of this effort to maximize access to an enterprise's intellectual property contained in its electronically stored information ("ESI") is to minimize the burden imposed on the client when it becomes a litigant subject to electronic discovery demands.  

Brian Rocca
Brian focuses on antitrust and complex commercial litigation. He also serves as the co-chair of Bingham's electronic document retention and discovery practice. He was recognized by Super Lawyers magazine from 2009-2011 as a "Rising Star" in the area of antitrust litigation. In the antitrust field, Brian has worked on high-stakes litigation in both civil and criminal contexts, and in a wide range of industries, including networking equipment, MP3 technology, electronic memory, wireless technology, microprocessors, freight forwarding, copier and printer sales and services, and medical products and staffing. Brian regularly advises clients in connection with governmental antitrust investigations and also provides counseling to a prominent trade association relating to alcohol distribution issues.   Brian has significant trial experience - he served as an assistant district attorney in the Trial Unit of the San Francisco District Attorney's Office in 2007-08 and as lead counsel in a federal civil rights trial in 2005. He also advises clients on cutting-edge electronic discovery and document retention issues, and has litigated several high-profile electronic discovery disputes.  

James D. Vaughn
James is a court-recognized expert who has given testimony in nearly 65 cases involving topics such as evidence preservation, documentation of events, and computer forensic methodologies and procedures. He is a Certified Forensic Computer Examiner who frequently speaks and consults clients on issues involving social media, and how to collect from social media sites for evidentiary purposes.
