In this session we will weigh the pros and cons of cloud computing and the unique information management and discovery challenges it poses to counsel. We will spend some time defining cloud computing by offering competing definitions for it. We will discuss why it is now relevant and how it can be used. We will identify some of the major issues presented by cloud computing, like monitoring content, security & privacy, and collection. We will describe some of the major discovery considerations like whether it should be considered ESI and due diligence to determine if discoverable. Finally, we will illustrate how technologies may be leveraged to meet the challenges identified.
