Biography

Jonathan Wilan is a Washington, DC based litigation partner. His practice over the last 18 years has focused on internal investigations, complex class action litigation and, more recently, providing strategic advice on transnational and major e-discovery matters. Mr. Wilan is a frequent speaker and author on complex issues related to information management and electronic discovery, with a particular focus on transnational discovery issues. He has appeared on panels at LegalTech, the Masters Conference on Electronic Discovery, IQPC Oil & Gas E-Discovery Conference, Corporate Counsel Magazine’s Annual General Counsel’s Conferences and an ABA ALI Panel on issues ranging from cloud computing to computer-assisted document review and discovery of social media.

Practice Focus

Mr. Wilan focuses his practice on working with corporate clients to respond to the challenges of electronic discovery and preservation under the Federal Rules of Civil Procedure and in response to governmental investigations. He also works proactively with clients to develop consistent systems and protocols to address e-discovery requirements.

Representative Legal Matters

Mr. Wilan is sought out for his expertise and management of complex litigation and investigative matters. Recent engagements include:

  • Regularly advising a variety of companies on complex and emerging E-Discovery and information management issues, including cloud computing, social media policies, cross-border discovery, and computer-assisted document coding.
  • Serving as the day-to-day manager for discovery on over 50 cases and investigations for a Fortune 150 telecommunications provider.
  • Serving as discovery counsel in a labor class action alleging systemic underpayment of commissions. Matter involves the extraction and analysis of over 500 million individual transaction records across dozens of systems to develop damages defenses.
  • Coordinating response to SEC and attorney general subpoenas.
  • Coordinating response to second requests.
  • Leading offensive and defensive discovery strategy in a RICO lawsuit.
  • Coordinating document discovery strategy related to alleged antitrust price-fixing conspiracy.
